SERVICES PROVIDED

AKapital Production provides:

• Video production and editing

• Photography and media services

• School-based film production programs

• Event coverage

• Creative development, scripting, and consulting

• Post-production services

• Graphic and promotional content creation

All services will be outlined in a written quote, invoice, or agreement prior to the project start date.

 

BOOKING & PAYMENT

Deposits

• A 50% deposit may be required to schedule or reserve production dates.

• Deposits are non-refundable unless otherwise stated.

Final Payment

• Remaining balance is due upon delivery of the final project.

• Late payments may incur a 10% monthly late fee.

• Accepted Payment Methods

• Credit/debit card, bank transfer, invoice payment, Apple Pay, Zelle or other approved methods.

 

CANCELLATION & RESCHEDULING

Client-Initiated Cancellations

• Cancellations within 72 hours of the scheduled shoot may incur additional fees.

• Deposits will not be refunded but may be applied toward a rescheduled date at our discretion.

AKapital Production Cancellations

• If we must cancel due to emergency, illness, or equipment failure, we will:

  • Reschedule at no extra cost OR

  • Refund any deposit or payments made.

 

OWNERSHIP & USAGE RIGHTS

Raw Footage & Materials

All raw footage, project files, and behind-the-scenes materials remain the sole property of AKapital Production, unless otherwise agreed.

Final Deliverables

Upon full payment:

• You are granted a non-exclusive, perpetual license to use the final video or media for personal, educational, or organizational promotion.

Marketing & Portfolio Rights

Unless otherwise agreed in writing:

• AKapital Production may use non-sensitive project content in its portfolio, website, demo reels, or marketing materials,

• EXCLUDING footage of minors without written school/guardian consent.

School Clients

• Student images or work will not be used for public marketing unless specifically authorized.

 

CLIENT RESPONSIBILITIES

You agree to:

• Provide accurate information and expectations

• Ensure access to locations, staff, or students needed for filming

• Handle permissions, student releases, and location clearance when applicable

• Maintain a safe filming environment

• Communicate changes in schedule or scope promptly

For school projects, the school is responsible for:

• Ensuring all students participating are authorized

• Managing any behavior, safety, or conduct issues

 

LIMITATIONS OF LIABILITY

AKapital Production is not liable for:

• Weather delays, location restrictions, or last-minute changes

• Lost or corrupted footage caused by acts outside our control

• Injuries, damages, or accidents caused by unsafe environments provided by the client

In the event of technical failure, our liability is limited to:

• A reshoot (when possible) or

• A refund up to the amount paid for the affected portion of the project

We are not responsible for indirect, incidental, or consequential damages.

 

REVISIONS

• Included Revisions

Most projects include 1–2 rounds of revisions (as stated in the quote).

• Additional Revisions

Revisions beyond the included amount will incur an additional fee, billed hourly or per change.

• Completion Timeline

Revisions must be submitted within 7 days of receiving the draft unless otherwise stated.

 

CONFIDENTIALITY

We respect all private and sensitive information.
We will not share confidential footage, documents, or project details except:

• With authorized school or organization contacts

• As required by law

• With client permission

 

INDEMNIFICATION

The client agrees to indemnify and hold AKapital Production harmless from:

• Claims arising from unauthorized use of music, logos, or copyrighted materials provided by the client

• Student or third-party actions during school programs or events

• Any misrepresentations made by the client

 

FORCE MAJEURE

We are not liable for delays or failure to deliver work due to causes beyond our control, including:

• Natural disasters

• Power outages

• Illness

• Equipment failure

• Acts of God

• Government or school-district restrictions

 

GOVERNING LAW

These Terms are governed by the laws of the State of New York.
Any disputes will be resolved in local state courts unless otherwise agreed.
